KOTA KINABALU: A local man was yesterday jailed for three years and ordered to be given one stroke of the cane for gang robbery last year.

Sessions Court judge Caroline Bee Majanil imposed the sentence on Fandy Saiman after he changed his plea of not guilty to guilty under Section 395 of the Penal Code when the case came up for trial yesterday.

The indictment carries a maximum jail of 20 years and whipping upon conviction.

Unemployed Fandy, 25, who was undefended admitted to robbing Julardi Jamari, 22, of his cellphone and a wallet worth RM1,050 at the roadside near a hostel in Menggatal on April 8, 2009.

On April 15 this year, Fandy’s co-accused Hafizan Mohammad, 24, was jailed for three years and received one stroke of the cane for committing a similar offence.

Deputy public prosecutor Afzan Abd Kahar prosecuted the case yesterday.
