KOTA KINABALU: The Sessions Court here will decide this July 5 whether the prosecution has established a case against a mobile phone salesman charged with insulting the Sultan of Perak Sultan Azlan Shah last year.High Court deputy registrar Zaini Fishir @ Fisal put off the ruling on the case of Rutinin Suhaimin, 37, who was defended by counsel Muammar Julkarnain.
Rutinin is accused of posting offending remarks on a website http://books.dreambooks.com/duliduli.html that was linked to the website of the Sultan of Perak, www.sultanperak.gov.my.
The alleged offence was committed at 6.33pm on Feb 13, this year, at Block A, Lot 4, Kedai Sedco, Kundasang in Ranau.
Rutinin is tried under Section 233(1)(9) of the Communications and Multimedia Act 1998 (Act 588), which carries a jail sentence of up to one year or a fine not exceeding RM50,000 or both upon conviction.
The trial started on Nov 30, last year with senior federal counsel Salim Soib Ahmad calling 19 witnesses before closing the prosecution’s case.
Rutinin claimed trial to the charge during his arraignment on March 13, 2009 and is currently released on RM10,000 bail with RM5,000 deposited under two local sureties.
