Logging firm fails to get leave to appeal

PUTRAJAYA: The Federal Court here yesterday refused to grant leave to a logging company to appeal against an appellate court’s decision which had set aside a mandamus order compelling the menteri besar of Pahang to pay RM70 million including interest, a judgment sum obtained by the company against the Pahang government.

With the majority 2-1 decision of a three-men panel yesterday, Seruan Gemilang Makmur Sdn Bhd is now faced with the dilemma on how and from whom in the Pahang government it should claim the RM70 million.

Seruan Gemilang was awarded RM37,127,471.60 million in damages with eight per cent interest per annum from Dec 31, 2000 by the Kuantan High Court on May 25 2007 after it won a breach of contract suit against the Pahang government and the state forestry director.

The state government and the state forestry department were found to have breached a logging concession contract concerning extraction of timber logs from a 10,000-acre plot of land belonging to Umno in Mukim Bebar, Pekan district. — Bernama
