Suit over baby’s death settled out of court

KUCHING: A father from Serian whose baby son died due to alleged negligence by a hospital during his delivery agreed to settle the case out of court yesterday.

The plaintiff, a wireman,  filed a negligence suit against the hospital after the boy died about four years ago.

He also named a doctor as one of the two defendants. The other plaintiff is the boy’s mother.

In the statement of claim, the mother was a patient under the care of the doctor during her pregnancy from May, 2005.

She was admitted to the hospital for the delivery of her baby.

Despite evidence of foetal distress, the defendant’s midwives and the doctor persisted in attempting normal delivery.

About 10am on Feb 6 2006, the baby was delivered by means of forceps and it suffered severe head injuries and a broken right arm.

The mother suffered internal injuries and severe pain, suffering and loss of amenity.

The baby passed away on its way home.

The parents claimed that the defendants failed to take any appropriate action.

The couple also claimed for special damages such as funeral expenses and other physical damages.

The statement of claim was filed through Messrs Ateng Jeros last year.
