Woman withdraws RM98.5 mln suit

KUALA LUMPUR: A housewife yesterday withdrew a suit filed against her estranged husband over alleged breach of trust involving their assets worth RM98.5 million.

High Court judge Harmindar Singh Dhaliwal struck out the suit in chambers upon an application by Fatimah Abdul Aziz’s counsel, Nizam Bashir, to withdraw the suit.

Speaking to the media, Nizam said the judge allowed the plaintiff’s (Fatimah) application to withdraw the suit with liberty to file a fresh suit.

Asked why the plaintiff wanted to file a new suit, he said its aim was to address some issues which arose at the hearing of the order to freeze at the High Court on Dec 10, last year.

Earlier yesterday, the court was scheduled to hear an application by Fatimah’s husband and two other people to strike out the suit, but it was superseded by her withdrawal application.

On Nov 23, Fatimah had filed a civil suit against her husband, Sannusi Ngah, his brother, Md Jais, and Budi Tenggara Sdn Bhd, an investment company owned by the brothers, over alleged breach of trust.

She alleged they had disposed off part of the assets without her consent and further claimed Budi Tenggara held shares in two companies, Hartalega Holdings Berhad (HHB) and Hartalega Industries Sdn Bhd.

The mother of a 16-year-old girl further claimed that her husband and brother-in-law had, from time to time, between April 2009 and July last year, been disposing off Budi Tenggara’s shares in HHB.

Fatimah is seeking a declaration that she and her husband have joint ownership of the HHB shares, general and exemplary damages, costs and other relief deemed fit by the court.

In her statement of claim, Fatimah said she had married Sannusi in 1998 but currently, they were estranged and in the process of getting a divorce at the Syariah court.

On Dec 10, last year, the High Court allowed the husband’s application to strike out a mareva injunction (freeze order) obtained by Fatimah on Nov 29, last year, to prevent him from disposing off the assets. — Bernama
