Man fined for injuring guard over alleged affair

KOTA KINABALU: A local man was fined RM600, in default, 20 days’ jail by the Magistrate’s Court here yesterday for injuring a security guard whom he accused of having an affair with his wife.

Magistrate Herlina Muse imposed the fine on Michael Chin Yun Then, 40, after he pleaded guilty to the charge under Section 334 of the Penal Code which carries a maximum four years’ jail or with a fine, or both, upon conviction.

Chin, who was unrepresented, admitted to causing hurt to a 42-year-old local man behind a restaurant at Kampung Nosoob, Penampang on September 1.

Prosecuting officer ASP Sabrina Jinius informed the court that on that day, the victim who was having a drink with a friend, was suddenly confronted by the husband (Chin) of his colleague.

The victim explained to the accused that he and his wife were only friends at their workplace.

Chin who was not satisfied with the explanation, became angry and beat the victim on the head and body with a wooden stick.

He was arrested by the police at an unnumbered house at Kampung Kobusak in Penampang.

The medical report indicated that the victim had received six stitches on his head, Jinius added.

In mitigation, Chin, when pleading for a lighter sentence, said the victim had provoked him until he became angry.
