Dealer ordered to pay for motorbike repair

KOTA KINABALU: The Consumer Claims Tribunal yesterday ordered a motorcycle dealer to pay RM600 for the repair of a motorcycle to a claimant here yesterday.

Claimant Amir Shah Zaman bought a second hand motorcycle from respondent, Oi Brothers Motor Station (M) Sdn Bhd for RM1,600.

However, Amir claimed that the respondent was unable to fix the problems with his motorcycle after sending it to the respondent’s workshop twice.

“Hence, he decided to repair his motorcycle at another workshop and demanded the respondent to pay for the repair cost of RM1,208.

Meanwhile, the respondent pointed out that his workshop could have fixed the problem with his motorcycle if the claimant had given them more time. The respondent said the claimant only gave the workshop a day to repair. The respondent did what he was told and suggested the claimant to bring his motorcycle back the next day for further repair, which the latter did not do.

Tribunal president Datuk Dr Lawrence S.H. Thien awarded RM 600 to the claimant as the repair cost of his motorcycle.

In a separate case, Thien granted an optical store Optivision two weeks to fix a pair of glasses for claimant Mosuli Joseph who bought the glasses worth RM1,430 from the store, which came with a one-year warranty.

After five months of usage, Mosuli said the lens of his glasses came off the frame, thus he brought the pair back to the store. He said it was due to a screw that had come loose.

However, Mosuli said the store asked him to pay RM 400 for the repair even though it was still under warranty. He claimed that the lens that the respondent replaced was also uncomfortable to his eye.

On the other hand, the respondent pointed out the reason that the lens detached from the frame was due to a crack on the lens, rather than a loose screw as the claimant said.

The respondent continued to say that the warranty only covered for the coating of the lens, and not for broken lens.

Nonetheless, Thien gave the respondent two weeks to repair the glasses.
