Armed robber gets 10 years and six months, whippings

SANDAKAN: A 35-year-old illegal immigrant was yesterday jailed for ten years and six months and given seven strokes for two counts of armed robbery and without possession of valid documents.

Husin Ibnu Hashim, pleaded guilty before Judicial Assistant Registrar Elsie Primus for robbing Mariana Joanes and Latif Jailani on January 16 and February 25 respectively.

The offence under Section 392/397 of the Penal Code provides for a jail term of up to 14 years and a fine, or whipping, on conviction.

According to the facts of the case, Mariana was cleaning her home around 8.30am on January 16 when she realized that a man, Husin, was at her home armed with a knife and a machete, threatening to hurt her if she did not give him money.

Fearing for her life, Mariana handed Husin RM150 in cash who then ran away.

For his second count, Husin robbed Latif Jailani of RM160 in cash around 4am on February 25.

Latif was at the market when Husin broke into his house where his wife,Suriani Sakkah and their four children were sleeping.

Suriani was awakened by several knocks on her window.

She proceeded to check on the noise and found a man standing outside who was asking her to let him in because he claimed to be an investigating officer.

When Suraini refused to let Husin in, the accused slammed the door forcefully until it broke open.

Husin, who was armed with a knife and machete, began raiding the house and found a wallet with RM170 in it.

Suraini pleaded to Husin not to take the money because she needed it to pay for her children’s school fees.

But Husin left RM10 behind for her and took the remaining RM160.

The police arrested Husin, who was carrying a knife at the time, at the intersection at Mile 10,on February 28.

Husin, who had spent all the money, admitted to committing the offences during police interrogations.

Both complainants identified Husin during an identification parade.
