Amok gets four years, whippings for injuring two men

KOTA KINABALU: A Filipino, who went amok and injured two men, was jailed for a total of four years and ordered to be given four strokes of the cane by the Magistrate’s Court here yesterday.

On the first and second counts, Arjir Ambali, 22, was sentenced to two years’ imprisonment and ordered to be whipped twice each after he admitted before magistrate Norhamizah Shaiffuddin to injuring two men aged 18 and 43 with a knife at the Telipok Temporary Settlement Scheme on November 8, 2011.

He was convicted under Section 324 of the Penal Code which is punishable by a jail term of up to three years, or with a fine, or with whipping or with any two of such punishments upon conviction.

Norhamizah ordered Arjir to serve his jail terms consecutively.

Prosecuting officer Inspector Syahrin Ali told the court that on the day of the incident the accused had entered the complainant’s house with a knife in his hand which had blood on it.

Then the accused stabbed the complainant’s brother twice on his chest, he said.

After that the accused chased after the complainant who ran for his life, Syahin said, adding that the accused then chased after the complainant’s nephew who was also stabbed in his back.

Syahrin also said the complainant, with the help of his other neighbours, managed to catch the accused and tied him up before being handed over to the police station.

Police investigation revealed that the accused went amok on that day and he admitted to injuring the two victims.

In her decision, Norhamizah took into consideration that this offence involved violence and she did not see any reason why the accused had committed the offence.

Asked by the court why he went amok on that day, the accused said he did not know what he did on that day.

Pleading for a light sentence, Arjir said that he has a family to support and his mother still needs him.

Syahrin pressed for a deterrent sentence taking into account the facts of the case and the trauma suffered by the victims’ families.

The prosecution requested for the jail sentences to run consecutively.

Meanwhile, the same court set June 19 this year for re-mention of Arjir’s murder case at the request of Syahrin as the DNA report of the victim was not ready yet.

No plea was recorded from the undefended Arjir, who was accused of killing a 17-year-old IMM13 holder at the same time and place.

The offence is framed under Section 302 of the Penal Code which provides for the mandatory death sentence upon conviction.
