Exemption applications are under assessment – MyCC

KUALA LUMPUR: The Malaysia Competition Commission (MyCC) has reiterated that all exemption applications from complying with the Competition Act 2010 are at an assessment stage, including that of Nestle.

“Exemption applicants are not automatically granted one,” said MyCC chief executive officer, Shila Dorai Raj.

She was responding to the Federation of Malaysian Consumer Associations’ claim that the MyCC had given the exemption to Nestle.

“All applications for exemptions must undergo the necessary assessment to determine if they meet the relevant criteria,” she said.

MyCC had previously reported that applications for block exemptions from complying with the Competition Act had been received from the Malaysia Shipowners Association, Shipping Association of Malaysia and Federation of Malaysian Port Operators Council, Association of Malaysian Hauliers and the Life Insurance of Malaysia.

Nestle Products Sdn Bhd is the sole applicant for individual exemption to date, it said.

MyCC also said there were four criteria that must be met to earn an exemption.

The first is that there are significant identifiable technological, efficiency or social benefits directly arising from the agreement. — Bernama
