Local quartet to be tried for robbery

KOTA KINABALU: Four local men were jointly charged in the Sessions Court yesterday with gang robbery using a machete.

Mohd Ryzal Zainudin, 27, Madrili Buara, 41, Mohd Naffasah Martinus, 24 and Mohd Afendy Jamainus, 35, were charged under Section 395 of the Penal Code, read together with Section 34 of the same Code and punishable under Section 397 of the same Code.

The offence carries a maximum jail of 20 years and whipping, upon conviction.

The four accused persons were alleged to have robbed a 20-year-old woman of two cellphones and RM100 in cash at a shop in Tuaran at 6.30pm on June 2.

The deputy registrar of the High Court Noor Hafizah Mohd Salim, who sat as a Sessions Court judge, set Aug 23 – 24 this year for their trial.

They were released each on RM10,000 bail deposited with RM2,500 with two local sureties, pending their trial.

Deputy public prosecutor Aida Jaafar Mad Ariff appeared for the prosecution.

In a separate case, Mohd Afendy will stand trial in the Magistrate’s Court on July 17 this year for a charge of carrying a machete in a public place.

He pleaded not guilty before magistrate Cindy Mc Juce Balitus to a charge framed under Section 6 (1) of the Corrosive, Explosive, Dangerous Weapons Act 1953 which provides for a maximum jail of two years, and whipping, upon conviction.

The alleged offence was committed at Kampung Contoh in Putatan at 12.45am on June 8.

He was denied bail and ordered to be further detained in custody under Section 259 of the Criminal Procedure Code, pending disposal of his case.
