Illegal jailed for hurting village head

TAWAU: A 53-year-old illegal immigrant was sentenced to five months’ jail by a Magistrate’s Court here yesterday for voluntarily causing hurt to a village head.

Magistrate Suhaila Silag meted out the sentence on Asgal bin Barang who pleaded guilty to a charge under Section 323 of the Penal Code which provides imprisonment not exceeding one year and fine up to RM2,000, or both.

The charge was read together with Section 34 of the same Act.

Prosecuting officer Inspector Joan Lee told the court that the accused with three others still at large, had voluntarily caused hurt to Sioh bin Jabidi, 54, on April 28 this year at about 5pm at Jambatan Pertama, Kampung Kurnia Jaya, Mile 4, Apas Road.

The village head was beaten by people he knew identified as Talip (the accused nickname), Iting, Binhal and Mokong.

According to police investigation, the village head wanted to help to return the engagement money of the accused’s daughter who had stayed a night at the victim’s house because she feared her father after the engagement was terminated.

The accused when informed, was angry as he was not told that his daughter had sought refuge at the village head’s house. When the victim approached the accused to help return the engagement money, the latter punched him in the face several times aided by three other men before he fled the scene.

Suhaila also ordered the accused who is serving a four-month jail sentence for entering the country illegally, to be referred to the Immigration Department for deportation.
