Worker charged for abusing, hurting son

KOTA KINABALU: A local general worker was charged in the Magistrate’s Court yesterday on three counts of physically abusing and voluntarily causing grievous hurt to his one-year-and-four-month-old son and for syabu abuse.

Tomli Ujin, 24, who appeared before magistrate Herlina Muse, was denied bail and ordered to be remanded under Section 259 of the Criminal Procedure Code, pending disposal of his case.

On the first count, the accused pleaded not guilty to injuring his son at an unnumbered house in Kampung Tunoh, Penampang between June 10 and June 25 about 4am and 5am.

He was charged under Section 31 (1) (a) of the Child Act 2001 which is punishable by a fine of up to RM20,000, or a maximum 10 years’ jail, or both, upon conviction.

However, the undefended accused, who was born in Kudat, admitted to his second count of causing grievous hurt to the same victim at the same time and place.

The offence was framed under Section 325 of the Penal Code which provides for a maximum seven years’ jail and a fine, upon conviction.

Meanwhile, on the third count Ujin was charged for alleged substance abuse in Penampang.

The indictment came under Section 15 (1) (a) of the Dangerous Drugs Act 1952, which carries a maximum fine of RM5,000, or a jail term of up to two years, upon conviction.

Herlina set July 30 this year to re-mention Ujin’s case, pending the production of a medical report of the victim.
