Hearing of appeal against acquittal of salesman postponed

KOTA KINABALU: The High Court here put off to September 6, this year for the hearing of an appeal by the prosecution against the acquittal of a local mobile phone salesman from a charge of insulting the Sultan of Perak, Sultan Azlan Shah, three years ago.

High Court judicial commissioner Lee Heng Cheong deferred the hearing of the appeal by deputy public prosecutor Uma Devi Balasubramaniam as counsel Muammar Julkarnain, who represents the respondent, Rutinin Suhaimin, 40, was sick.

Uma is appealing against the Sessions Court’s decision on July 12, 2010, to acquit and discharge the respondent without his defence being called.

The lower court ruled that the prosecution had failed to establish a case against him.

Rutinin had allegedly posted an offending remark on a website, http://books.dreambooks.com/duliduli.html that was linked to the website of the Sultan of Perak, www.sultanperak.gov.my.

The alleged offence was committed at 6.33pm on February 13, this year, at Block A, Lot 4, Kedai Sedco, Kundasang in Ranau.
Rutinin was tried under Section 233 (1)(9) of the Communications and Multimedia Act 1998 (Act 588), which carries a jail sentence of up to one year or a fine not exceeding RM50,000, or both, upon conviction.
