Application to reduce jail sentence dismissed

KOTA KINABALU: The High Court here yesterday dismissed a local man’s application for a reduction of his seven months jail sentence for dishonestly retaining a stolen motorcycle’s engine.

Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum affirmed the custodial sentence imposed by the Magistrate’s Court here on Matran Bakrim, 25, after hearing submissions from the latter’s counsel Ram Singh and reply from deputy public prosecutor Uma Devi Balasubramaniam.

In his decision, Malanjum held that there was no reason for the court to interfere with the decision of the subordinate court.

The Magistrate’s Court had on March 22, this year imposed the sentence on the appellant after he pleaded guilty to retaining the stolen Honda motorcycle’s engine belonging to one Mohamad Nazry Jaludin at Lorong Lantas in Kampung Likas about 2.30am on March 15.

He was convicted under Section 411 of the Penal Code which provides for a jail term of between six months and five years and is also liable to a fine on conviction.

Earlier Ram, among others, submitted that the appellant bought the stolen item and it was later recovered by police.

He added that the item was also in good condition.

In her rebuttal, Uma told the court that the sentence imposed by the lower court was not too severe and the appellant is expected to be released from prison on August 5, this year.
