PETALING JAYA: A Bangladeshi was yesterday sentenced to 13 years’ jail and five strokes of the cane by the Sessions Court here yesterday for raping a slow-witted student last year.

Judge Yasmin Abdul Razak handed down the sentence on Mamun, 31, after finding that the defence had failed to raise reasonable doubts against the prosecution’s case.

Mamum was ordered to serve the sentence from the date of his arrest on Feb 16, 2011.

The Bangladeshi car washer was charged with raping the girl, then aged 12 years old and nine months, at a vacant shop at Jalan PUJ, 3/12, Taman Puncak Jalil, Selangor, on Feb 14 last year.

Deputy public prosecutor Chong Yin Xin prosecuted, while lawyer Gurmit Singh represented Mamun.

In the same court, a construction worker was acquitted and discharged for the rape of a primary school girl two years ago.

Yasmin ordered Misnam Asmawi, 24, to be freed after finding that the prosecution had failed to establish a prima facie case against him.

Misnam, represented by lawyer Esther Tan, was charged with raping the 12-year-old girl at Lot 3311-14 Kg Paya Jaras Hilir, Sungai Pelong, Selangor, between October and November 2010. — Bernama
