PUTRAJAYA: The Home Ministry is to seek the advice of the Attorney-General on whether or not to appeal a High Court decision today quashing an order of the minister declaring Bersih 2.0 an unlawful society.
Minister Datuk Seri Hishammuddin Tun Hussein said in a statement that the ministry would scrutinise the grounds of the judgement.
“I respect the decision of the court which quashed the home minister’s order of July 1 last year which declared Bersih 2.0 an unlawful society,” he said.
Judge Datuk Rohana Yusof, in her decision, allowed the petition by 14 members of the Bersih 2.0 steering committee, including Datuk S. Ambiga, to quash the minister’s order on the basis that Bersih 2.0 comprised a coalition of registered organisations.
In her 30-page judgement, Rohana ruled that the decision to declare Bersih 2.0 unlawful was made without taking into account some relevant facts or by taking into account some irrelevant facts.
