Girl, dad withdraw rape report against factory operator

KOTA KINABALU: The Sessions Court here yesterday granted a discharge not amounting to an acquittal to a local factory operator who was charged with three counts of raping his teenage lover.

Judge Caroline Bee Majanil made the decision after the victim and her father came to the court and informed that they had withdrawn the report against the accused, Jairin Samud, 31, from Kota Belud.

The victim and her father had agreed to settle the matter at village level.

Jairin allegedly raped the girl, who was 15 years and eight months old, at a hotel in Pekan Goshen, Kota Marudu at 9.45am on June 21, 2010.

He allegedly committed the same offence against the girl in a car at the roadside in a Kota Marudu village about 7pm on June 30, 2010.

He was also accused of raping the girl at a hut near a river in Kota Marudu about 9am on July 16, 2010 and threatening her with a hammer.

Jairin was defended by counsel P.J Perira, while deputy public prosecutor Afzan Abd Kahar prosecuted. Counsel Ariel Dasan stood in for Perira.

This case was first brought to the court on June 1 this year.
