Youth to be tried for raping minor

KOTA KINABALU: A local youth will be tried at the Sessions Court here on September 6 to 9, this year for a charge of raping a 15-year-old girl last month.

High Court deputy registrar Amir Shah Amir Hassan yesterday fixed the trial date for Mohd Hazrynnyzam Nasir, 19, after he pleaded not guilty to the charge.

Amir Shah, who sat as a Sessions Court judge, released the accused on RM3,000 bail to be deposited with two local sureties and ordered him to report himself once a week to the nearest police station pending disposal of the case.

Mohd Hazrynnyzam allegedly raped the girl at a storeroom of a restaurant here about 1.50pm on July 18.

He is charged under Section 376 (1) of the Penal Code which carries a jail term of up to 20 years in jail and is also liable to whipping on conviction.

Deputy public prosecutor Chow Siang Kong told the court that the prosecution would be calling seven witnesses to testify against the accused during the trial.

Mohd Hazrynnyzam is represented by counsel Sazalye Donol.

Meanwhile in another Sessions Court, judge Azreena Aziz fixed September 6, this year, for case management for a 25-year-old foreigner who claimed trial to a charge of entering the state illegally.

Jason Rodolfo is accused of committing the offence at a house in Kampung Bambayong, Inanam about 11.30am on July 27.

The offence comes under Section 6 (1) (c) of the Immigration Act 1959/63 and provides for a fine not exceeding RM10,000, or a jail term of up to five years, or both, and with whipping, upon conviction.

The accused was ordered to be remanded under Section 259 of the Criminal Procedure Code pending disposal of the case.
