Local man to hang for murder

TAWAU: A 30-year-old local man who claimed self-defence was sentenced to death by hanging by the High Court here yesterday for murder.

Judicial Commissioner Datuk Douglas Cristo Primus Sikayun found Abdul Samid bin Edward guilty to a charge under Section 302 of the Penal Code which provides for the mandatory death sentence upon conviction when the case came up for ruling yesterday.

Abdul Samid was charged with voluntarily causing the death of Budi bin Sohide, 30, at a bus stop hut at Kampung Kurnia Jaya, Mile 4, Apas Road on October 11, 2008, at about 11pm. The deceased died due to an incised wound on the neck which injured the vertebra artery.

Sikayun found there was a prima facie case and relevant evidence by the prosecution where defense was called.

Deputy public prosecutor Hamdan Hamzah presented a written submission that stated the facts of the case were quite straight forward. It was only the accused who strangled the deceased at the time when the deceased was inflicted with the injuries. Thereafter, Public Witness 1 saw the accused walking across the road and saw the accused covering his hand with a towel tainted with a lot of blood and the accused’s shirt also tainted with a lot of blood.

The accused was defended by appointed counsel Jhasarry P. Kang. During the trial that started on March 29, 2011, the prosecution called nine witnesses and the defence called two witnesses.
