Wireman claims trial to hurting woman in robbery

KOTA KINABALU: A local wireman will be tried in the Sessions Court on Sept 25 to 26, this year for causing hurt to a person while committing a robbery.

High Court deputy registrar Amir Shah Amir Hassan yesterday set the dates for the trial of Mohd Syaibatulhamdy Assobah Mohd Nordin, 22, after he submitted a plea of not guilty to the charge.

Amir Shah who sat as a Sessions Court judge, said that a date for case management would be determined by the registrar.

Mohd Syaibatulhamdy was accused of causing hurt to 28-year-old accounting officer, Lequeez Mulai, while robbing her of a shoulder bag containing two hand phones, RM850 cash, four ATM cards and other personal belongings.

He was alleged to have committed the offence near Taman Seri Maju in Menggatal about 7pm on August 8, this year.

The offence under Section 394 of the Penal Code provides for a jail term of up to 20 years, and is also liable to whipping, on conviction.

The court released the unrepresented accused on a RM10,000 bail, RM5,000 to be deposited with two local sureties, pending disposal of the case.

Deputy public prosecutor Wan Aiman Azwan Wan Fakhruddin prosecuted.

Meanwhile in the Magistrate’s Court, Mohd Syaibatulhamdy pleaded guilty to a charge of possessing syabu but his sentencing was deferred to Sept 18 pending the chemist’s report.

He was found to have consumed the drug at the Kota Kinabalu police station on the same day.

He was charged under Section 15 (1) (c) of the Dangerous Drugs Act 1952 which provides for a fine not exceeding RM5,000, or a jail term of up to two years, or both, upon conviction.
