Trader charged with murder

KOTA KINABALU: A trader from Johor was preliminarily charged in the Magistrate’s Court yesterday with the murder of a man in Donggongon more than two weeks ago.

Lee Tiam Chye, 43, was alleged to have killed a 58-year-old man at a restaurant in Donggongon, Penampang about 12.45pm on August 10.

The charge was framed under Section 302 of the Penal Code which provides for the mandatory death sentence upon conviction.

No plea was recorded from Lee who was represented by counsel Ram Singh.

The court set October 30 this year to re-mention the case to allow for the production of the DNA report of the victim and other relevant documents.

Lee was ordered to be further remanded under Section 259 of the Criminal Procedure Code pending disposal of his case, as murder is a non-bailable offence.

Meanwhile, a local man was fined RM4,500, in default, two years’ jail by the Magistrate’s Court yesterday for possessing 2.56 grams of ketamine last year.

Derek Chong, 27, was fined after he admitted to a charge framed under Section 12 (3) of the Dangerous Drugs Act 1952.

The provision carries a maximum fine of RM100,000, or a jail term of up to five years, or both, upon conviction.

The prosecution told the court that the undefended accused was arrested at a car park of a building in the city on June 22, 2011.
