KOTA KINABALU: A trader from Johor was preliminarily charged in the magistrates’ court yesterday with the murder of a man in Donggongon more than two weeks ago.

Lee Tiam Chye, 43, was alleged to have killed a 58-year-old man at a restaurant in Donggongon, Penampang about 12.45pm on August 10.

The charge was framed under Section 302 of the Penal Code which provides for the mandatory death sentence upon conviction.

No plea was recorded from Lee who was represented by counsel Ram Singh.

The court set October 30 this year to re-mention the case to allow for the production of the DNA report of the victim and other relevant documents.

Lee was ordered to be further remanded under Section 259 of the Criminal Procedure Code pending disposal of his case, as murder is a non-bailable offence.
