Court sets Sept 13 to hear objections against Anwar Ibrahim’s application to refer point of law

KUALA LUMPUR: The Sessions Court yesterday set Sept 13 to hear the prosecution’s objections against Datuk Seri Anwar Ibrahim’s application to refer a point of law to the High Court in relation to the three charges on the Bersih 3.0 gathering.

Deputy Public Prosecutor Abdul Wahab Mohamad told the court Anwar’s lawyer, Karpal Singh, informed the prosecution of the application only this morning and they needed more time to peruse the matter.

The defence should provide an explanation for such applications as it would have an effect on the prosecution’s initial submission against Anwar’s application to drop all the three charges against him, which was set for today.

Karpal Singh filed the latest application at the High Court Criminal Registry here with a supporting affidavit from Anwar, stating that the High Court should decide as to whether Section 4 (1)(c) and 4(2)(c) of the Peaceful Assembly Act 2012 was in accordance with the Federal Constitution.

Anwar also sought to halt all Sessions Court proceedings pending the decision on the matter.

Anwar, Parti Keadilan Rakyat (PKR) Mohamed Azmin Ali and Rembau PKR chief, Badrul Hisham Shaharin, were jointly charged under the Penal Code, with other Bersih 3.0 supporters still at large, with inciting Tangam Raju, Rajesh Kumar Gejinder and Farhan Ibrahim to violate the Magistrates’ Court order issued on April 26.

Meanwhile, Karpal Singh informed the court that he was currently also representing Badrul Hisham.

Datuk C V Prabhakaran who represented Mohamed Azmin told the court that he would be filing a separate application at the High Court in reference to the point of law. — Bernama
