Jailed 12 months for beating alleged rapist to death

SANDAKAN: The Sessions Court here sentenced a man to 12 months’ imprisonment and a referral to the immigration department for beating up a man who allegedly tried to rape his sister.

According to the facts of the case read by prosecuting officer Dominic Chew Ban Huat, the accused Alung Husin, heard noises from a chicken pen upon reaching home on Aug 8, at around 1.30pm.

Reaching the chicken pen, Alung heard his sister’s voice coming from the bushes behind the pen and when he went to investigate, he found the victim, Mosran Sogeng, trying to rape his sister.

In a state of rage, Alung attacked Mosran on his body, left rib and shoulder with his hands and was witnessed by Rhwasin Podin.

Others who heard about the rape attempt confronted Mosran and attacked him but then they ran away.

Mosran died shortly after.

Police investigations have proven that Alung and several others who are still free had caused injury to Mosran.

Alung was initially tried for Section 304(B), for murder, but pleaded not guilty to the charge.

He, however, pleaded guilty to Section 323, causing hurt.

Represented by Sharatha Masyrah John Ridwan Lincon, Alung was sentenced under Section 323 of the Penal Code for voluntarily causing hurt which provides a jail term of up to one year, or a fine not exceeding RM2,000, or both, on conviction.
