Man gets 10 years’ jail, six lashes for gang robbery

KOTA KINABALU: A local man was sentenced to a total of 10 years’ jail and ordered to be given six strokes of the cane by the Sessions Court for two counts of gang robbery.

Judge Caroline Bee Majanil passed the sentence on Herry Kudan @ Jas Parak, 31, after he pleaded guilty to
both charges.

The undefended Herry was jailed for seven years and ordered to be whipped thrice on the first charge of robbing a 53-year-old woman of RM1,000, a cellphone, a gold bracelet and RM100 worth of reload coupons, altogether valued at RM2,000, at a grocery shop in Kampung Dambai, Menggatal on March 8.

Herry committed the offence with two other accomplices and he was armed with a knife and samurai sword.

He was convicted under Section 395 of the Penal Code, punishable under Section 397 of the same Code which carries a maximum jail of 20 years and whipping, upon conviction.

On the second count, he received another five years’ jail term and three lashes of the cane for attempting to rob a 43-year-old man and causing hurt to the victim at premises at Jalan Pantai on Dec 19, 2011.

The offence framed under Section 394 of the Penal Code provides for a maximum 20 years’ jail and also liable to whipping, upon conviction.

The court ordered the accused to serve his jail sentences consecutively.
