Father claims trial to child abuse charge

KOTA KINABALU: A 35-year-old man will face trial in the Magistrate’s Court on Oct 29 to 30 on a charge of abusing his five-year-old son.

Magistrate Nuruhuda Mohd Yusof fixed the dates for Benjie Tupay to be tried after he pleaded not guilty to the charge.

Benjie stands accused of abusing his infant son by hitting his thigh and leg with a belt and burning his cheek with a mosquito coil resulting in the boy to suffer multiple injuries to his body, thigh, leg and face.

He was alleged to have committed the offence at a house in KPD complex, Tanjung Lipat between 6am and 6pm in August.

He faces the prospect of being fined up to RM20,000 or jailed up to 10 years, or both, if he is found guilty of the charge framed under Section 31( 1) of the Children Act 2011. The accused was ordered to be remanded further under Section 259 of the Criminal Procedure Code pending disposal of the case.

In another case, a 39-year-old local man who pleaded guilty to injuring his wife will know his fate when the verdict will be handed down on Oct 10.

The magistrate deferred sentencing to allow for the production of the medical report of the victim. Kevin Cheam Heng Seng admitted to committing the offence about 12.15am on Aug 1 at a house in Taman Angsana, Kolombong.

He is charged under Section 323 of the Penal Code which carries a jail term of up to one year or a fine not exceeding RM2,000, or both, on conviction.

The unrepresented Cheam was released on RM2,000 bail, to be deposited with two local sureties pending disposal of the case.

Meanwhile, two men were each jailed for six months after they pleaded guilty to a joint charge of stealing a woman’s hand bag and a hand phone. Masrin Jasirin, 33, and Awang Damit Pg Mulok, 26, stole the items from a car which was parked by the road side near a pub about 1.30am on Aug 30. The duo were convicted under Section 379 of the Penal Code which provides for a jail term of up to seven years or a fine, or both, on conviction.
