Judgement deferred for teen in murder of man

KUCHING: The Sessions Court yesterday deferred to Thursday the delivery of judgment on a teenager who pleaded guilty to culpable homicide not amounting to murder of a man in February this year.

Judge Timothy Finlayson Joel made the decision after some matter arising during the proceeding, and released the 18-year-old accused on extended bail pending his sentencing.

The teenager from Kampung Serpan Laut in Asajaya was initially charged under Section 302 of the Penal Code for murdering Azrul Aban, 23, near a bridge around 11pm on Feb 4.

The Section provides for the mandatory death penalty.

He was offered the lesser charge under Section 304 of the Penal Code for the same offence which he admitted to.

In yesterday’s appearance which was supposedly fixed for sentencing, the deceased’s family was present.

The accused was represented by defence counsel Abdul Rahman Mohd Hazmi while DPP Poh Yih Tinn prosecuted.

In another lower court room, two brothers and a woman, suspects in the 7-Eleven robbery that happened at Premier 101 and Kota Sentosa, were placed on four-day remand.

The woman is the wife of one of the male suspects.

The suspects in their late 20s had allegedly robbed the two outlets within a space of 40 minutes early Saturday morning.

Court Registrar Aida Montong granted the police investigation officer’s application to detain them to facilitate investigation.

Their remand order expires on Sept 14.

The case is being investigated under Section 395 of the Penal Code for armed gang robbery that calls for a maximum 20 years’ imprisonment and possible whipping.
