Oct 3 case management of Indonesian charged with robbing nurse

KOTA KINABALU: The Sessions Court here set October 3 this year for case management of an Indonesian man charged with robbing a nurse.

Judge Caroline Bee Majanil yesterday granted deputy public prosecutor Afzan Abd Kahar’s request for another case management date for Arip Sadika’s robbery case.

Afzan told the court that the 46-year-old gardener had just appointed lawyer Rakhbir Singh to represent him in this case.

She pointed out that under the law, both parties are required to conduct a pretrial conference.

The court also allowed Rakhbir’s application for the accused’s passport to be returned to the latter for renewal purposes as it will expire on September 28, this year.

Caroline ordered the accused to surrender his passport again to the court during the next case management hearing.

Arip is accused of robbing the 26-year-old woman of a hand phone, jewelleries and RM30 cash all together worth RM3,000 at 7pm on June 13, this year by the roadside near the Fire and Rescue Department quarters in Jalan Sulaman, Menggatal.

He is liable to a jail term of up to 14 years and is also liable to a fine, or whipping, if found guilty of the alleged offence under Section 392 of the Penal Code.

The accused had on June 22 claimed trial to the charge and is currently released on RM2,500 bail with three local sureties pending disposal of the case.

The prosecution will be calling five witnesses to testify against the accused.
