Timorese given 14 years, whippings for raping disabled girl

KOTA KINABALU: A jobless Timorese, who pleaded guilty to the rape of a disabled girl, was sentenced to 14 years’ jail and ordered to be whipped thrice by the Sessions Court yesterday.

The deputy registrar of the High Court, Zulkifli Abllah, imposed the sentence on Sius Toka, 47, who was charged under Section 376 (1) of the Penal Code, punishable by a maximum jail of 20 years and whipping upon conviction.

The accused raped the 15-year-old girl at a house in a village in Kota Belud on September 2.

Deputy public prosecutor Monica Linsua told the court that the incident took place when the victim’s parents were not at home. The matter came to light after a neighbour, who is the victim’s friend, told the girl’s parents that their daughter confided to her that she was raped by the accused. The victim’s father later lodged a police report.

Police investigation revealed that the accused had raped the victim since June this year.

Sius Toka was also charged in the same court with overstaying in the State, but no plea was recorded from the accused who was arrested for committing the alleged offence in Kota Belud on September 4.

The indictment came under Section 15 (1) (c) of the Immigration Act which provides for a jail term of up to five years, or a fine of up to RM10,000, or both, upon conviction.

Zulkifli who sat as a Sessions Court judge, fixed September 25 this year for re-mention of the case.
