Rape: Rubber tapper to enter defence

KOTA KINABALU: The Sessions Court yesterday ordered a local rubber tapper to enter his defence on a charge of raping a 10-year-old girl.

In her reserved ruling, the deputy registrar of the High Court Noor Hafizah Mohd Salim, ruled that the prosecution had established a prima facie case against Anggryke Micheal @ Gabun.

The 22-year-old accused was alleged to have raped the minor at a house in a village in Membakut at 4pm on Jan 7.

The offence was framed under Section 376(2) (e) of the Penal Code which carries a jail term of between five years and 30 years and whipping, upon conviction.

Noor Hafizah who presided as a Sessions Court judge fixed Oct 3 – 5 this year for Michael, who was defended by counsel Hairul Vyron Othman, to enter his defence.

Deputy public prosecutor Aida Jaafar Mad Ariff had called seven witnesses to testify during the trial.

The accused was defended by counsel Hairul Vyron Othman.
