KOTA KINABALU: The High Court yesterday ordered a local businessman to enter his defence against a charge of trafficking in 4,674.3 grams of ketamine last year.

Justice Datuk David Wong Dak Wah ruled that the prosecution had established a prima facie case against 27-year-old Mohana Dass S/O Velayutham and set October 29 for the latter to make his defence.

Velayutham allegedly committed the offence at Terminal Two of the Kota Kinabalu International Airport (KKIA) at 4.30pm on July 31, 2011.

He faces the mandatory death sentence if he is found guilty of the offence under Section 39B (1) (a) of the Dangerous Drugs Act 1952.

The trial started on April 2 this year with the prosecution producing eight witnesses to testify against the accused who was represented by counsel Rakhbir Singh.

Deputy public prosecutor Naziah Mokhtar prosecuted.
