Used car dealer ordered to refund RM7,500 deposit

KOTA KINABALU: The Consumer Claims Tribunal here yesterday awarded a man’s claim for the refund of the RM7,500 deposit he paid for the pruchase of a used vehicle.

The claimant, Abdul Hamid Wahap, said he purchased the vehicle from AA Auto through a middleman, Ariffin Dzulkiflee, on March 12 this year.

Abdul Hamid, who named AA Auto as the first respondent, Ariffin as the second respondent and the original car owner Saleha Nordin as the third respondent, said he had paid the montly loan installments for the car for two months but the car was towed away Ariffin after he (the claimant) failed to make the next three monthly payments.

Abdul Hamid claimed the car was towed away a few days before the three-month payment deadline was up, and Ariffin did not produce an authorization letter when he took back the vehicle.

On the other hand, Ariffin claimed he had presented the claimant with the authorization letter and had even given the latter seven days to claim back his vehicle from him.

He said all the payments by the claimant were received by AA Auto.

Tribunal President Datuk Lawrence S.H. Thien ordered the first respondent, AA Auto, to refund the deposit of RM7,500 to the claimant within 14 days.
