Longer jail sentence for trying to murder cop

KOTA KINABALU: The High Court here yesterday enhanced a local man’s jail sentence from three years to seven years for attempting to murder a policeman.

Justice Dato’ Abdul Rahman Sebli allowed the prosecution’s appeal against the three years’ jail sentence imposed by the Sessions Court on Zul Ahmad on grounds that the said sentence was manifestly inadequate.

In this case, Sebli said the respondent was not a first offender and had two previous convictions, namely armed robbery and gang robbery.

He pointed that the person the respondent attempted to kill was a policeman and he (the respondent) had used a knife when committing the offence.

Sebli stressed that this type of criminal conduct could not be tolerated.

The Sessions Court had on March 5, this year sentenced Zul to three years’ jail after finding him guilty of attempting to murder Constable Mustaza Hossen at an unnumbered house in Kampung Kembirinan, Menggatal about 12.25pm on May 20, 2011.

Zul was convicted under Section 307 of the Penal Code which carries a jail term of up to 10 years and is also liable to a fine upon conviction.

The respondent was unrepresented while deputy public prosecutor Uma Devi Subramaniam appeared for the appellant.
