Hearing postponed in appeal against death penalty

KUCHING: The Federal Court here yesterday postponed the hearing on a man’s appeal against a death penalty for drug trafficking.

The date has yet to be fixed.

A five-member panel of judges led by Chief Justice Tun Arifffin Zakaria made the decision after the appellant Chung Ngee Hong through his defence counsel Voon Lee Shan and prosecutor DPP Musli Abdul Hamid tendered their submissions.

On Aug 24 last year, Chung was convicted for trafficking in 85.37g of methylenedioxy methamphetamine (MDMA) and was convicted of a charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39B(2) of the same act.

He committed the offence at about 2am at No. 116, Lot 916, Poh Kwong Park on April 25, 2003.

He was also charged under Section 12(2) of the same act for possessing 50.6g of nimetazepam.

The fact of this case revealed that while at Batu Kawa Road, the appellant led police to find drugs hidden in a computer speaker in Chung’s bedroom.

A packet containing 14 plastic bags with 50 red tablets each and two plastic bags with 50 yellow tablets each were found in the bedroom.

The police also found the word ‘delta’ on a carbon paper used to wrap 30 strips of the pills.

The other four judges were Tan Sri Richard Manlanjum, Tan Sri Abdul Hamid Embong Datuk Suriyadi Halim Omar and Datuk Hasan Lah.
