Jail, fine reduced for man in reckless driving case

KUCHING: The High Court here yesterday allowed a man’s appeal against the conviction and sentence of five years’ jail and a RM5,000 fine, in default three months’ jail, for reckless driving which caused the death of a woman four years ago.

Justice Dato Rhodzariah Bujang reduced Hasri Junaidi’s sentence to six months’ jail and RM2,000 fine, in default three months’ jail.

The appellant had been found guilty by the Lower Court for reckless driving that resulted in him colliding with a car and causing the death of a 55-year-old woman at Taman Kopidim.

On the day of the incident, Hasri was driving in front of Taman Kopidim when he signalled to enter a left junction but instead turned to the right junction thereby colliding with the car at about 3pm on April 7, 2009.

He was convicted of a charge under Section 41(1) of the Road Transport Act 1987.

Yesterday the appellant was also granted a stay of execution, pending his final appeal to the Court of Appeal.

In another case, the Court dismissed a prosecution’s appeal against the acquittal of a man driving recklessly, and causing the death of a woman.

The Court affirmed the verdict meted by a magistrates’ court here to discharge the respondent Louis Neil Ainsworth from the alleged offence on April 25 this year.

Louis allegedly hit a motorcyclist at Jalan Sungao Moyan at about 8pm on April 15.
