Two men jailed for stealing

KOTA KINABALU: The Magistrate’s Court here yesterday jailed two local men for seven months after they pleaded guilty to separate theft charges.

In the first case, Musa Moktar, 23, pleaded guilty before magistrate Cindy Mc Juce Balitus to stealing RM512 cash belonging to a policeman.

He committed the offence at the policeman’s house in Kampung Pasir Putih near here about 11am on September 14, this year.

The facts of the case stated that the complainant went to Kudat and let the accused, who was a friend of the complainant’s brother-in-law, stay at his house.

However, when he returned, he found that the accused was not at home and later discovered the money missing.

He then went to Gaya Street and found the accused before taking him to the police station.

While in the car, the accused owned up to his wrongdoing after being questioned by the complainant.

However, when they reached at a roundabout in Putatan, the accused suddenly jumped out of the car with the intention to run away but was injured.

The complainant then brought the accused to the police station after the latter recovered from the injury.

In the second case, Mohd Makrun Abdul Rauf, 25, admitted to stealing a handphone worth RM1,000 belonging to a 32-year-old woman at a shop in Putatan about 4.45pm on September 25 this year.

The facts of the case stated that the accused and his friends entered the shop and pretended to buy clothes.

The accused then took the woman’s handphone which she put at the counter when the victim was entertaining his friends.

However, the woman noticed that her handphone was with the accused who was about to leave the shop after the handphone’s SMS ring tone rang.

The woman then shouted and asked the accused to give back her handphone which the accused did before fleeing the shop.

However, the accused was apprehended by other shops’ workers after they heard the woman’s screams for help and later handed him over to police.

Musa and Mohd Makrun were convicted under Section 380 of the Penal Code which provides for a jail term of up to 10 years or a fine upon conviction.
