KOTA KINABALU: The Corruption Court yesterday re-scheduled to Oct 16, 17 and 25 this year for the trial of a staff of the Kota Kinabalu Courts House charged with receiving a bribe from a woman as payment for a late registration of birth.
The judge adjourned the trial of Jinny Daniul, 30, after her counsel, Ram Singh, informed the court that he had to attend to a criminal trial at the High Court in Sandakan.
The accused was charged under Section 16 (a) (B) of the Malaysia Anti-Corruption Commission Act 2009 and punishable under Section 24 of the same Act, with receiving RM50 in cash from the woman in return for a late registration of birth document to enable the woman to obtain a birth certificate for her daughter without any trial before the magistrate.
The indictment carries a maximum jail of 20 years and a fine no less than five times the amount of bribe or RM10,000, whichever is the higher, upon conviction.
She was alleged to have committed offence at the Kota Kinabalu Court house between November and December, 2010.
Meanwhile, the accused also faces an alternative charge of dishonestly using as genuine a birth certificate registered under the name of the woman’s daughter bearing a faked signature of the magistrate at the same time and place.
The offence was framed under Section 471 of the Penal Code, punishable under Section 465 of the same Code, which provides for a jail term of up to two years, or a fine, or both, upon conviction.
Jinny was currently released on a bail of RM10,000 with RM5,000 deposited with two local sureties, pending disposal of her case.
