Self-employed charged with forging document

KOTA KINABALU: A 63-year-old self-employed was charged at the Sessions Court here yesterday with forging a valuable security document.

Local Joseph Ling is accused of forging a Power of Attorney between Lin Ying Chun and Tsai Hisu Chun that gave the accused the authority to sell a bungalow to Alpha Resource Sdn Bhd and he had allegedly received all the money incurred from the sale of property.

He allegedly committed the offence at Nicholas Fung Tokuzip & Co on the second floor, No 8, in Jalan Pantai here between 2pm and 5pm on July 12, 2007.

The offence under Section 467 of the Penal Code carries a jail term of up to 20 years and is also liable to a fine upon conviction.

The accused, who is represented by counsel Chin Tek Ming, is also facing an alternative charge of using the forged valuable security document as genuine for the same purpose.

He was alleged to have committed the offence between 8am and 5pm on October 20, 2008 at Messrs J Ambrose & Suite, seventh floor in CPS tower, Centre Point shopping complex here.

The offence under Section 471 of the Penal Code, punishable under Section 467 of the same code, also provides the same punishment upon conviction.

Joseph pleaded not guilty to both charges and High Court deputy registrar Zulkifli Abllah, who sat as a Sessions Court judge, released the accused on RM12,000 bail, with RM6,000 to be deposited and two local sureties pending disposal of the case.

Zulkifli said that the case management and trial of the accused would be fixed later.

In another case, 37-year-old Filipino Jamal Ismail pleaded guilty to robbing Voon Sui Liong of a hand phone and a wallet containing his personal documents and RM1,200 cash outside the CIMB ATM in Inanam about 2.30am on August 12, this year.

He committed the offence together with an accomplice who is still at large.

The court fixed tomorrow (Thursday) for re-mention of the case to give the accused enough time to decide on whether to plead guilty to the charge or otherwise after noticing that the latter was not very sure about his guilty plea.

In the meantime, the court ordered the accused to be remanded further under Section 259 of the Criminal Procedure Code.

Jamal is liable to a jail term of up to 14 years and is also liable to whipping if convicted of the offence under Section 395/397 of the Penal Code.
