KUCHING: A jobless youth from Kampung Bintawa charged with possessing 3.92g of methamphetamine and self administration of the drug was yesterday ordered to stand trial on Nov 28 and 29.
The accused Chong Sim Khai, 26, appeared before Magistrate Gerald Empaling Donald who fixed the date after the case was mentioned in his court yesterday. He also fixed Nov 12 for case management hearing.
Chong, who is represented by Counsel Roger Chin, was released on a cash bail of RM5, 000 with one surety until the disposal of the case.
For the first charge, Chong allegedly possessed the dangerous drug when he was nabbed at a parking space at Central Park, Mile 3, here about 11pm on Aug 2.
For the second charge, he allegedly tested positive of methamphetamine and amphetamine when he was brought to the police headquarters for investigation about 3am the next day.
Drug possession charge comes under Section 12(2) Dangerous Drugs Act 1952 and punishable under Section 39A(2) of the same act which carries a life imprisonment and whipping upon conviction.
Self administration of drugs comes under Section 15(1)(a) of the same act and the offender is liable to a fine not exceeding RM5,000 or to imprisonment term not exceeding two years.
