Burglar gets 96 months, two strokes

PLEADED GUILTY: Nipar being brought out of the magistrates’ court.

TAWAU: A 36-year-old local man was jailed for 96 months and ordered to be whipped twice by the Magistrate’s Court here yesterday for burglary.

Nipar Vergiano pleaded guilty before Magistrate Puan Suhaila Selag to two charges under Section 457 of the Penal Code which carries a jail term up to 14 years and a fine and whipping if convicted.

The court ordered the accused to serve the sentence separately and undergo police observation for four years after the conviction.

Prosecuting officer Inspector Joan Lee told the court that the accused had committed the first offence with a friend who is still at large at Kampung Kurnia Jaya, Mile 4, Apas Road here about 4.30am on Aug 3, this year.

They broke into the house of Norhayah Aliuddin and stole her handbag.

Police detained the accused at Kampung Kurnia Jaya about 5.35pm on the same day after after the victim lodged a report.

For the second charge, the accused and his friend, Mahadlan Sapaat, had broken into an unnumbered house at Kampung Hidayat belonging to Mazli Sabtu, 59, about 4.30am on Oct 13, this year.

Mahadlan stole a handbag belonging to Rosiah Mazli who was sleeping in the living room.

The incident was witnessed by Mustafa Juli who detained Mahadlan and handed him to the police. Nipar was arrested at Kampung Kurnia Jaya on the same day.
