Ahmad Zubair seeks to have CBT charges against him dropped

KUALA LUMPUR: Former Sime Darby Bhd president and group chief executive officer Datuk Seri Ahmad Zubair Murshid has filed an application to have criminal breach of trust (CBT) charges against him dropped.

The head of his legal team Datuk Mohd Yusof Zainal Abiden submitted the application to Sessions Court judge Datuk Jagjit Singh Bant Singh here yesterday.

Mohd Yusof told reporters afterwards that a similar application would be made to the High Court soon.

Meanwhile, the prosecution led by Deputy Public Prosecutor Kevin Anthony Morais has also made an amendment in the two main charges against him.

The amendment involves changing ‘suffering losses through payment of Maybank cheque’ to ‘for making payment to the amount of.’

Ahmad Zubair had pleaded not guilty when charged with two counts of CBT involving RM100 million at the Sessions Court on July 17. The charges under Section 409 of the Penal Code were related to acquisition of land in Sarikei under the Sarawak Upstream Expansion Plan.

He had also pleaded not guilty to two alternative charges of cheating under Section 418 of the same code for allegedly failing to inform Sime Darby’s board of directors that the NCR (Native Customary Rights) lands in Sarikei had instead been awarded to Vertical Drive and Nature Ambience.

All the offences were alleged to have been committed at the office of Sime Darby Berhad, 21st Floor , Wisma Sime Darby, Jalan Raja Laut,here between Nov 17 2008 and Dec 4 2009. — Bernama
