Two friends given a discharge not amounting to acquittal for drug possession

PETALING JAYA: The Sessions Court here yesterday granted a dischargenot amounting to an acquittal on two friends charged with possessing 12gm of morphine two years ago.

Judge Yasmin Abdul Razak made the ruling on R.R.K Aharjunan, 27, and P Sorajani, 33, following a request by the defence, represented by lawyer T Suresh, as the case had been going on for almost two years and failure of the last prosecution witness to attend hearing of the case eight times to testify.

In setting them free, Yasmin told Aharjunan and Sorajani that they could be charged again.

They were charged with committing the offence in front of a bank Seri Kembangan at 3.30pm on Nov 24, 2010.

Earlier, the prosecution, represented by deputy public prosecutor Chong Yin Xin, requested the court to issue a warrant of arrest on the witness, Zulkefli Edin, a chemist, for failing to attend hearing of the case.

Chong said attempts by the investigating officer in the case to contact the witness had been futile.

Zulkefli, 38, was needed in court to explain the change of colour in an exhibit in the case. — Bernama
