Duo on death row lose appeal

KOTA KINABALU: Two men, including a contractor from Sarawak, failed in their separate appeals against conviction and death sentence for drug trafficking and murder.

The Court of Appeal here yesterday dismissed the appeal by contractor Heng Cheng Ming who was sentenced to death for trafficking in 150.50 grams of syabu seven years ago.

Court of Appeal judges Datuk Abdul Wahab Patail, Datuk Mohamad Ariff Md Yusof and High Court judge Datuk David Wong Dak Wah unanimously affirmed the 46-year-old Heng Cheng Ming’s death penalty.

Heng, who was defended by counsel Rakhbir Singh, was arrested at Kota Kinabalu International Airport Terminal One Departure Hall on January 4, 2006, and sentenced to hang on June 12, 2009.

He was found guilty on a charge under Section 39B (1) (a) of the Dangerous Drugs Act 1952. which provides for the mandatory death sentence on conviction.

Deputy public prosecutor Samihah Rhazali appeared for the respondent.

In the other case yesterday, the Court of Appeal here also unanimously upheld the death sentence imposed on a jobless man for murder after hearing submissions from both the appellant and the respondent.

The appellant, Lee Fook, 44, was sentenced to hang by the High Court here on Feb 24, 2010, for murdering a 51-year-old man at Taman Bambangan, Kampung Madsiang, Jalan Tambunan, Penampang on July 24, 2008.

He was found guilty on a charge under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction.

Deputy public prosecutor Siti Rafidah Zainuddin appeared for the respondent while counsel Mohd Fauzi Formusa represented Lee.
