Business operator fined for causing hurt

TAWAU: A 39-year-old local business operator was fined RM700, in default, three months’ jail by a Magistrate’s Court here yesterday for causing injury.

Magistrate Edward Paul meted out the sentence on Andi bin Abwada, 39, who pleaded guilty to a charge under Section 334 of the Penal Code which provides one month’s imprisonment or RM1,000 fine, or both.

Prosecuting officer Inspector Joan Lee told the court that the accused hurt and provoked Abdul Sapri bin Ahmad, 22, at Pasar Gantung, Jalan Klinik about 7.15am on July 22 this year.

Joan said the accused and Muhamad Jefri bin Ahmad had a misunderstanding over the position of their tables where both were operating business at a street next to Pasaraya Parkwell.

Both of them argued before they were calmed down by the public. When the victim and his brother drove away in a Ford Ranger to park at Pasar Gantung area, they saw the accused was driving a van from behind and suddenly rammed their vehicle.

The victim’s brother and the accused came down from the vehicles. The latter suddenly swung a wood which was avoided by the victim. A struggle ensued and the victim was strangled, punched in the face and his eyes were poked before his brother came down from the Ford ranger and took him inside the car.

The accused was hurt on the neck while his friend was injured in the right hand.

Meanwhile, a 22-year-old local man was placed under two years of good behaviour bond and ordered to pay a RM700 deposit by the Magistrate’s Court for hurting two men.

Edward meted out the sentence on Abdul Sabri bin Ahmad who pleaded guilty to both charges under Section 335 of the Penal Code which provides four years’ imprisonment or RM4,000 fine, or both.

The accused injured Andi bin Abwada, 39, and Komoni bin Zul on July 22 this year between 7am and 7.20am in front of Pasar Gantung, Jalan Klinik using a sword.

The accused argued with the first victim when he found his table for doing business was shifted from its position in front of Pasaraya Parkwell.

The victim called the second victim who came and shifted the table and the accused moved away from the place with his brother to avoid a fight.

They went into their Ford Ranger and parked at Pasar Gantung at Jalan Klinik before the victims inside a van rammed their vehicle from behind.

The accused came out and swung a sword at the first victim who was holding a wood and the first victim was hurt on his neck. The accused swung the sword at the second victim and hit the victim’s right hand.

After a struggle, the accused was hurt on his head and face and his brother came out from the Ford and brought him to the hospital.

He was detained on the same day while making a police report.
