Murder case of four Filipinos set for re-mention on Feb 4

KOTA KINABALU: The High Court here yesterday set February 4 next year for re-mention of a case involving four Filipinos charged with gang robbery and murder of a local taxi driver in Beaufort, 10 months ago.

Judge Datuk David Wong Dak Wah adjourned the case of Joy Felix, 20, Mohd Shah Faizal, 21, Bonjovi Mahmud, 18, and Mazlan Anong, 18, who were defended by counsels Nelson W. Angang, Loretto S. Padua Sipin Jr, Datuk Norbert Chin and Wotti Junius respectively.

The four accused were alleged to have killed the 42-year-old man while robbing him at Kampung Padas valley in Beaufort at 10am on March 14 this year.

The indictment was framed under Section 396 of the Penal Code which is punishable with the mandatory death sentence or an imprisonment term of up to 30 years and also liable to whipping upon conviction.

On June 27, the High Court here had sent back to the Magistrate’s Court in Beaufort the case of the four Filipinos.

Justice Dato’ Abdul Rahman Sebli has remitted the case back to the lower court after being informed by the deputy public prosecutor (DPP) that the case was transferred to the High Court without a consent under Section 177E of the Criminal Procedure Code from the DPP’s office.

Earlier, on April 17, the Magistrate’s Court in Beaufort had transferred the case to the High Court here at the request of the prosecution, who said that they had received an instruction from the DPP’s office.

This case was first brought to the court on March 30 this year.

DPP Monica Linsua appeared for the prosecution.
