Foreigner jailed for stealing from restaurant

KOTA KINABALU: The magistrates’ court here yesterday jailed a foreigner for four months for breaking into a restaurant and stealing coins and cigarettes.

Magistrate Herlina Muse imposed the sentence on Jamil Agayan, 25, who pleaded guilty to a charge under Section 457 of the Penal Code which provides for a jail term of up to 14 years and also liable to a fine upon conviction.

The undefended accused had trespassed on the restaurant in Likas and stole RM80 in coins and 30 boxes of cigarettes.

The court also ordered the accused to be referred to the Immigartion Department for further action after serving his sentence.

In a separate case, a woman was jailed for one year for consuming syabu.

Nartih Khilin, 23, was caught after her urine sample tested positive for drug abuse at Karamunsing police station on November 18.

She was charged under Section 15 (1) (a) of the Dangerous Drugs Act 1952 which provides for a fine not exceeding RM5,000 or a jail term of up to two years, or both, upon conviction.

The accused was also ordered to be put under police supervision for two years.

Earlier, prosecuting officer Inspector Lim Swee Beng urged the court to impose an appropriate sentence taking into account that the accused had also made noise during the court proceedings.
