Appeal of convicted rapists dismissed

KUCHING: The High Court here yesterday dismissed the appeal of two convicted rapists.

Justice Yew Jen Kie handed down the decision after hearing the submission made by prosecutor DPP Musli Abdul Hamid and the convicts, Kuken Ham and Amor Singit.

Kuken, 40, and Amor, 45, were each sentenced to 17 years’ jail and six strokes of the rotan after they were found guilty of raping an underage girl in October last year.

Amor received another eight years’ jail and five lashes for attempted rape to make it 25 years’ jail and 11 lashes altogether.

They were found guilty of committing gang rape on a 17-year-old college student under a tree near Semariang Cemetery between 2am and 4.45am on Oct 6, 2011.

Amor was also found guilty of committing the second offence at an abandoned house at Bamfylde Road on the same day.

Yesterday, Justice Yew ordered a cash bail of RM20,000 each imposed by the presiding Sessions Court judge for their stay of execution, pending appeal to the High Court.

She also imposed another RM10,000 bail in two sureties to release them after granting their application for stay of execution pending their appeal to the Court of Appeal, their final avenue.
