KUCHING: Two men charged with culpable homicide of an elderly man, Walina Halida, from Samarahan last year will know their fate on Monday (Dec 31).
Yesterday High Court judge Datuk Yew Jen Kie deferred judgment on Solihin Bujang Rasdi and Baim Mail after they changed their plea to guilty to the amended charge under Section 304(a) of the Penal Code.
Justice Yew needed time to consider the submission made by defence counsel Abdul Rahman Mohd Hazmi who defended the two accused under Section 172 of the Criminal Procedure Code.
Section 172(i)(d)(ii) said the accused was entitled to half of the penalty but confined to selected cases.
Solihin, 22, a wireman and Baim, 34, a car mechanic face 30 years in jail under Section 304(a).
Solihin from Kampung Paya Mebi and Baim from Kampung Pangkalan Kuap allegedly committed the offence at the deceased’s house at Kampung Pelanduk in Samarahan between 3.30pm and 11.30pm on June 26.
Their original charge was murder which comes under Section 302 of the Penal Code which carries a mandatory death penalty upon conviction.
