Youth gets jail, cane for raping little girl

KOTA KINABALU: A local youth who raped a seven-year and nine-month-old girl was yesterday sentenced to four years’ jail and four strokes of the cane.

Salmon Pensil, 19, admitted before High Court deputy registrar Hafizi Abd Halim, who sat as a Sessions Court judge, to a charge under Section 376 (1) of the Penal Code which carries a maximum jail term of 20 years and whipping.

He committed the offence at a house in a Kota Belud village on June 22, 2008.

He was charged under Section 376 (1) of the Penal Code which carries a maximum jail of 20 years and also liable to whipping, upon conviction.

Deputy public prosecutor Chow Siang Kong prosecuted.

In the Immigration Court here yesterday, a woman from China was fined RM4,000, in default, six months?jail for holding a passport with a fake endorsement.

Wu Tian, 21, pleaded guilty before judge Azreena Aziz to a charge under Section 56 (1) (L) of the Immigration Act 1959/63, which provides for a maximum fine of RM10,000 or a jail term up to five years.

The accused who was represented by counsel Chua Kuan E was arrested at the arrival hall of the Kota Kinabalu International Airport here on December 11, 2012.

Immigration officer Shaiful Izuat Abd Shani prosecuted the case.

Meanwhile, the Sessions Court here yesterday sentenced a local man to eight years’ jail and 12 strokes of the cane for possessing 36.37 grams of syabu (methamphetamine).

Terence Ryner Sohan Singh, 32, admitted before High Court deputy registrar Hafizi Abdul Halim, who sat as a Sessions Court judge, to possessing the drug at the car park at Gereja Baptis, Jalan Bunga Raya, Tanjung Aru on Sept 3, 2012.

He was charged under Section 39A (2) (r) of the Dangerous Drugs Act (DDA)1952 which provides for a life imprisonment or a jail term of not less than five years and whipping of not less than 10 strokes.

Deputy public prosecutor Chow Siang Kong prosecuted the case.

In the Magistrate Court here yesterday, a warrant for the arrest of a local man in a syabu abuse case was extended to January 8 who was charged with consuming syabu.

Magistrate Norhamizah Shaiffuddin extended the warrant after Hayry J Hermanto, 37, failed to show up in court when the case came up for mention yesterday.

The court had issued the WOA on Oct 1, 2012.

The accused, who allegedly consumed the drug in Kampung Lokub, Menggatal on July 31, 2012, was charged under Section 15 (1) (a) of the DDA 1952 which provides for a fine not exceeding RM5,000 or a jail term of up to two years or both.

Inspector Azaman Hamat prosecuted the case.
